STANDARD TERMS & CONDITIONS
The following Terms of Service apply to professional services supplied by SPATTER/ED Ltd [Company Registration No. 12602691]. Our registered office is at Elizabeth House, 13-17 London Road, Newbury, Berkshire, RG14 1JL, United Kingdom. These terms apply to any sale of services, including digital content on our sites. If you buy services or digital content on our sites you agree to be legally bound by this contract and the terms and conditions contained herein.
These terms and conditions apply to all sites where they are displayed, or where they have been issued separately, including but not limited to www.spattered.co.uk and spattered.thinkific.com and in all cases for work done and services that you procure from us unless any other (or additional terms) are agreed with you in writing before work commences.
Please read these terms and conditions before you buy anything from us, including via our websites, and check that they contain everything that you want and nothing that you are not willing to agree to.
By law, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, SI 2013/3134 say that we must give you certain key information before a legally binding contract between you and us is made (see below). Use of Site and Services
SPATTER/ED Ltd maintains all websites and training courses offered (“Sites”)’ for the use of its customers, vendors, students, and other Site users (“Users”) upon agreement to the terms outlined here. SPATTER/ED Ltd also provides various materials, information, quizzes, tests, questions, articles, news and other information on our websites and in training courses (the “Materials”). Please read these terms carefully before using any of our services, including training courses that comprise Materials that can be accessed via our Sites, as using them indicates your acceptance of these terms and forms a binding agreement between you and SPATTER/ED Ltd. If you do not agree to these terms, do not use our Sites, Materials or Services.
Term of Use and Intellectual Property Rights
When you buy any services from us, including access to digital content, or are provided with Materials by us, you do not own them. Instead, we give you permission to use them (aka a ‘license’) for the purpose of education and training according to this contract. SPATTER/ED Ltd retains all copyright and other proprietary notices contained in the original Materials and on any copies of the Materials.
The digital content is personal to you, and you can use it wherever you want in the world but only if you comply with local laws. The material is non-exclusive and we may supply the same or similar digital content to other Users. SPATTER/ED Ltd will provide each User with access to one copy of the Materials (digitally or in print) and Users must keep all Materials confidential. Digital formats may only be used on two computers or devices by you and it must not be copied by you except for reasonable use in order to complete the training.
You MUST NOT
Change or modify our Materials (which means in particular that you are not allowed to adapt, reverse-engineer or decompile them or try to extract the source code from them).
Combine or merge or use our Materials in any other format, or computer program.
Distribute, share or sell our Materials to any third-party.
Conceal, change, modify or remove any markings which show who owns this information and Material, such as brand, copyright ©, registered trademark ® or unregistered trademark TM markings.
Sell, auction, loan, rent, give away, describe, summarise, or otherwise reveal the Materials or their contents, to any other person or entity.
Any unauthorised use of any Materials may violate copyright, trademark, and other laws. Any breach of these Terms of Use automatically terminates your authorised use of our Services and Sites.
No Warranty
The Materials provided are provided “as is” without any warranties of any kind including warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property. SPATTER/ED Ltd further does not warrant the accuracy and completeness of the Materials and may make changes to the Materials, or to the services and prices described in them, at any time without notice. Whilst every effort will be made to ensure that the Materials are current, there may be some Materials that fall out of date. SPATTER/ED Ltd makes no commitment to update the Materials.
Hyperlinks
Links to external websites and resources are provided solely as a convenience to you. SPATTER/ED Ltd has not reviewed all of these external websites, does not control and is not responsible for any of these sites or their content. If you decide to access any of the external websites linked to our Sites, you do so entirely at your own risk.
Ordering from us
You can place an order for our services directly, or online via one of our Sites. At the end of the checkout process (e.g., when you confirm payment) we will acknowledge your order by email. This acknowledgement does not mean that your order has been accepted. We may contact you to say that we do not accept your order. This typically happens because the services are no longer available, we cannot authorise your payment, you are not allowed to buy the services or digital content from us (note you must be over 18 years of age to access our online training for example), the number of services or digital content you have ordered is too large, there has been a mistake on the pricing description or the services digital content. We will only accept your order when we send you an email to confirm this (‘confirmation email’) and at this point a legally binding contract will be in place between you and us.
The price of the services or digital content that we provide is in pounds sterling (£,GBP) and includes VAT at the applicable rate. Our VAT number is GB353383495.
We will do all that we reasonably can to ensure that all of the information you give us when paying for services or digital content is secure by using an encrypted and secure payment mechanism. All payments by credit card or debit card need to be authorised by the relevant card issuer. From time to time we may use extra security steps via verified by Visa, MasterCard® securecodeTM or equivalent services.
Right to cancel
You have 14 days to change your mind, cancel your purchase and get a full refund on any digital content or services that you procure from us. You do not have the right to cancel if you have used our services or digital content (e.g. undertaken any of the training purchased), and in these situations you may be charged for what you’ve used. The cancellation period will expire after 14 days from the day on which this contract was entered into. To exercise the right to cancel you must inform us of your decision to cancel your contract in a clear statement e.g. in an email to [email protected].
Your consumer rights
The services that we provide must be as described, fit for purpose and of satisfactory quality, so if you are unhappy with the service that you procure from us we will strive to find a solution within a reasonable timeframe and without significant inconvenience to you. Where necessary you may be able to get some, or all of your money back. We will use all reasonable efforts to ensure that any digital content that we provide is free from defects, viruses and other malicious content. We do not promise that it will be compatible with third-party software or equipment and you acknowledge that there may be minor errors or bugs in it.

Security and storage of data and data protection
We respect your data and operate a policy that is commensurate with GDPR regulations in respect of data collection, storage and processing practices. We undertake security measures to protect against unauthorised access, alteration, disclosure or destruction of your personal information and data stored by us.
All personal information relating to individual clients of SPATTER/ED Ltd, and anyone else with whom we have professional dealings will, where applicable, be kept confidential and processed in accordance with the Data Protection Act 1998 and in accordance with the policies and directives of the Information Commissioner’s Office (ICO), with whom we are registered.
Our use of that information is subject to your instructions, the Data Protection Act 1998 and our duty of confidentiality to you. We only use your personal information to administer your account and to provide the professional service that you have requested from us. Please note that our work for you may require us to give information to third parties such as other professional advisers so that they can assist in specifically administering the service or training that you have requested. You have a right of access under data protection legislation to the personal data that we hold about you.
We may from time to time like to contact you with details of other training and services that we provide. Before we do this, we will first ask if you consent to us contacting you for this purpose. We will also ask you to confirm how you would like us to contact you. We operate a paperless policy where possible and so unless you require a hard copy, we would usually send marketing information by email, or contact you by phone or text message. We check digital media or e-mail messages for viruses but we cannot be responsible for the security of correspondence and documents sent by e-mail. If you allow us to store your information for marketing purposes, we will not share your information with external agencies or third parties.
If, at any point, you want us to delete your information from our marketing database please notify us by writing to [email protected].

Complaints
Customer service is at the heart of everything that we do, but if you have any cause to complain about our services in the first instance you should raise your concerns with the person who is dealing with your matter. If you are dissatisfied with their response you should set out, in writing, the nature of your complaint and send this for review to SPATTER/ED Ltd at [email protected] and an independent person will deal with your matter. They will also acknowledge receipt of your complaint in writing within 14 days. They will then consider your complaint and carry out an investigation and will provide a proposed solution within 10 business days. If the matter is complex and it takes longer to deal with your complaint, we will contact you within 10 business days to give you an approximate timescale of when you can expect a response. If we believe it would be helpful, we may suggest a meeting. We will then provide you with a substantive written response. If you remain dissatisfied with the written response, you have the right to take the matter further and we would comply with any reasonable adjudication process to find a solution.
Our insurance provider is Hiscox Underwriting Limited through JELF, Partnership House, Priory Park East, Kingston Upon Hull, HU4 7DY; telephone 01482 213215; fax 01482 213216. We have professional indemnity insurance and public liability insurance and details of the level of cover can be provided as necessary.
